1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and FoodMate ("we", "our", or "us") governing your access to and use of the FoodMate mobile application and related services (collectively, the "Service").

By downloading, installing, or using FoodMate, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

FoodMate is a personal food management application that helps you:

Certain features use artificial intelligence to generate personalised meal suggestions, pantry-focused next moves, weekly meal plans, daily insights, nutrition estimates, waste reduction tips, receipt parsing, and food or pantry photo analysis. These AI-generated outputs are for informational and convenience purposes only.

3. Eligibility

You must be at least 13 years of age (or 16 in the European Economic Area) to use FoodMate. By using the Service, you represent that you meet this age requirement.

If you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

You must not use the Service if you are prohibited from doing so under the laws of the country in which you reside.

4. Your Account

Registration

To access most features of FoodMate, you must create an account using a valid email address and password, or via a supported third-party sign-in provider (Google or Apple). You agree to provide accurate and complete information during registration and to keep this information up to date.

Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@foodmate.fit if you suspect unauthorised access to your account.

One Account Per Person

You may not create multiple accounts for the purpose of circumventing restrictions, gaining unfair advantage, or abusing any free tier or trial period.

Accuracy of Account Settings

You are responsible for keeping your profile, allergies, dietary preferences, currency, language, timezone, unit system, and household settings accurate. FoodMate uses these settings to personalize suggestions and reminders.

5. Acceptable Use

You agree to use FoodMate only for lawful purposes and in accordance with these Terms. You must not:

6. Your Content

Ownership

You retain ownership of all content you submit to FoodMate, including inventory data, photos, receipt scans, nutrition logs, meal plans, recipe ratings, comments, and profile photos ("Your Content").

Licence to Us

By submitting content to FoodMate, you grant us a non-exclusive, worldwide, royalty-free licence to store, process, analyze, transform, and display Your Content solely for the purpose of providing, securing, maintaining, and improving the Service. We do not claim ownership of Your Content and will not use it for advertising or sell it to third parties.

Community Content

Content you submit to community features (such as recipe ratings and comments) may be visible to other users. You are solely responsible for ensuring that any content you post does not violate the rights of others or these Terms.

Photos, Receipts, and Scans

If you upload or scan a receipt, product barcode, pantry, fridge, or food photo, you confirm that you have the right to provide it. Receipts and images may contain personal information; avoid uploading anything unnecessary or sensitive.

Content Removal

We reserve the right to remove any content that violates these Terms or that we determine, in our sole discretion, is harmful, offensive, or otherwise inappropriate.

7. Subscriptions & Payments

Free and Premium Tiers

FoodMate offers a free tier with access to core features. Certain advanced features may require a paid subscription ("Premium"). Details of what is included in each tier are available within the app.

Billing

Premium subscriptions are billed through the Apple App Store in accordance with Apple's payment terms. By subscribing, you agree to Apple's terms and conditions for in-app purchases. Prices, billing period, renewal terms, and any free-trial details are shown in the app before purchase. We do not directly handle payment card information.

Cancellation

You may cancel your subscription at any time through your Apple App Store account settings. Cancellation takes effect at the end of the current billing period. Deleting your FoodMate account does not automatically cancel an active App Store subscription; you must cancel the subscription through Apple. Refunds and billing disputes are handled by Apple except where applicable law requires otherwise.

Price Changes

We may change subscription pricing at any time. We will provide at least 30 days' notice of any price increase, and your continued use of the Service after the price change takes effect constitutes your acceptance of the new price.

Free Trials

We may offer free trial periods for Premium features. If you do not cancel before the trial ends, you will be automatically charged the applicable subscription fee.

Restoring Purchases

If you reinstall FoodMate or change devices, you can use the restore purchase option in the app. Premium access depends on Apple's purchase records and RevenueCat entitlement validation.

Apple In-App Purchases: All payments for Premium features are processed by Apple. For billing disputes or refund requests, please contact Apple Support directly.

8. AI-Generated Content

FoodMate uses artificial intelligence to generate meal suggestions, weekly plans, shopping lists, nutritional insights, food analysis results, budget and waste insights, and other recommendations. You acknowledge and agree that:

Allergy & Medical Notice: Always verify ingredients and nutritional information independently, particularly if you have food allergies or medical dietary requirements. Do not rely solely on FoodMate for allergy-critical decisions.

9. Third-Party Services

FoodMate integrates with third-party services including Supabase (data storage and authentication), OpenAI (AI processing), RevenueCat (subscription entitlement management), PostHog (product analytics), Google (optional sign-in), Apple (optional sign-in and payments), USDA FoodData Central (nutrition lookup), and Open Food Facts (barcode lookup). Your use of these services is subject to their respective terms and privacy policies.

We are not responsible for the availability, accuracy, or practices of third-party services. Links or references to third-party services within the app do not constitute our endorsement of those services.

10. Intellectual Property

The FoodMate application, including its design, code, branding, logo, and original content, is owned by us and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand identifiers.

You may not copy, reproduce, modify, distribute, or create derivative works of the Service or any part of it without our prior written permission.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

Nutritional data, expiry date estimates, budget projections, waste estimates, CO2 estimates, shopping-list estimates, and food safety information within the app are provided as a convenience only and should not be relied upon as a substitute for professional advice, product labelling, your own judgement, or official food-safety guidance.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) €10 (TEN EUROS).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

13. Termination

By You

You may stop using FoodMate at any time and delete your account via the Profile tab in the app or by contacting us at support@foodmate.fit. Account deletion permanently removes your personal data from FoodMate within 30 days, except where retention is required by law. Account deletion does not cancel an active App Store subscription; subscription cancellation must be handled through Apple.

By Us

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if we are required to do so by law. Upon termination, your right to use the Service ceases immediately.

Effect of Termination

Sections 6 (Your Content — licence terminates upon account deletion), 10 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), and 14 (Governing Law) survive any termination of these Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Norway, except where mandatory consumer protection laws in your country of residence provide otherwise.

If you are a consumer in the European Union, you may also be entitled to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our business practices. When we make material changes, we will:
